The Official Journal of Trade Marks (OJTM) will no longer be the official place that we advertise and notify the public about Trade Marks Office actions.
Material that we currently advertise in the OJTM will instead be published on either Australian Trade Mark Search (ATMS), IP Australia's website or the Trans-Tasman IP Attorneys website.
Most items relating to the conduct of the Trade Marks Office, including filings, acceptances and registrations of trade marks will be published in ATMS. You can find links to ATMS and related tools, along with help and guidance on conducting searches at Search existing trade marks.
Items published on IP Australia's website from 17 May 2024 will be:
1. Notice of matters for which an assisted filing service (TM Headstart) request is not available - reg 3A.3(3)(f).
- For example, special kinds of signs, series, certification, collective, defensive and divisional applications are currently excluded from this service by prior notice in the OJTM.
- For TM Headstart requests from 17 May onwards, the relevant exclusions are now available at Conditions relating to TM Headstart requests. Any future changes to these exclusions will be announced on our website.
2. Notice of conditions relating to TM Headstart requests - reg 3A.3(3)(g).
- For example, requests currently must be filed online and use the picklist.
- For TM Headstart requests from 17 May onwards, the relevant conditions are now available at Conditions relating to TM Headstart requests. Any future changes to these conditions will be announced on our website.
3. Non-legislative instruments determining means of filing documents (s 213A), form of documents (s 213B), directions in relation to the filing of evidence (s 213C), means of paying fees (s 223AA).
Copies of the most current instruments were originally in the OJTM, but copies are now available at IP Legislation In Australia.
4. Days when the Trade Marks Office is not open for business - s 223A(2)(b) and reg 21.24B(3).
Historically, this has been to notify of the period of any end of year shut down.
Decisions of the Trans-Tasman IP Attorneys Disciplinary Tribunal will be published on the Trans-Tasman IP Attorneys Website – reg 20A.19.
Over the coming months we will work through all of our customer-facing materials so that references to 'advertised' or ‘notified’ in the OJTM are updated as having been 'published' on the relevant website or ATMS. We will continue producing the OJTM until all of those materials have been updated. In the meantime, any reference to advertisements or notifications in the OJTM should be taken as publications on the website or ATMS.
