Fees and timelines

Today
Submit your request. After you pay your initial assessment fee, a trade mark examiner will review and reply within 5 business days about whether your trade mark will likely be registrable if you apply. You can then decide if you want to go forward and submit your application.

After 5 days
After you receive your initial assessment, you will then have 5 business days to decide to lodge your application and pay the lodgement fee. You will also have an opportunity to change or update your application to address any issues found by the examiner (some additional fees may apply).

After 4 months
Once the lodgement fee is paid, your application will be immediately published and an examiner will review your application within 10 business days. If there are no issues and your application is accepted, we will publish the accepted status on Australian Trade Mark Search 4 months after the lodgement fee is paid.
If we identify barriers to the acceptance of your mark, we will give you 15 months to overcome them. Due to international agreements, the earliest we publish your acceptance is 5 months from the priority date. -
After 6 months
After acceptance, there is a 2 month-long 'opposition period' where your application may be opposed. If no one opposes your application, we will register the mark approximately 65 days after the acceptance is published. Initial registration lasts 10 years from the date you paid your lodgement fee.
