IP First Response

IP First Response is a pilot resource developed by IPAVentures to help individuals and businesses understand their options when facing potential intellectual property infringement.

This tool provides structured guidance on enforcement pathways, options, and timeframes. During its initial phase, the platform focuses on patents and trade marks, with user feedback shaping future enhancements.

While not a substitute for professional advice, IP First Response serves as an entry point for those unsure about enforcement, improving confidence in IP protection and adapting to evolving user needs.

Why are we doing it?

Traditionally, IP Australia's role has been to grant IP rights, leaving enforcement to rights holders. However, research by IPAVentures identified a key gap: many small and medium enterprises (SMEs) and individual rights holders struggle to navigate IP enforcement pathways.

Through early research and stakeholder engagement, we found:

  • Limited visibility of enforcement options reduces the value of owning IP rights.
  • Resource imbalances puts smaller businesses or individuals at a disadvantage in enforcement.
  • Information gaps on negotiation or alternative resolution methods can leave rights holders unsure of next steps.

IP First Response aims to address these challenges by making IP enforcement more accessible and understandable – without replacing professional advice.

What are we doing?

At the core of this initiative is a digital tool designed to help users explore potential IP enforcement options relevant to their situation.

How it works:

  • Users answer a short series of questions about their IP concern.
  • The tool guides users toward the most relevant enforcement pathways.
  • The alpha version focuses on patents and trade marks, which form a substantial component of the inquiries IP Australia receives.

This pilot will evolve based on user feedback, shaping future improvements and expanding support for rights holders.
